Goldberg Kohn achieves landmark decision ensuring under-privileged children in receive the medical care they deserve.

Goldberg Kohn worked with the Sargent Shriver National Center on Poverty Law on a pro bono basis to represent a class of 600,000 children on Medicaid in a lawsuit against the Illinois Department of Public Aid and the Illinois Department of Human Services. The case was the broadest challenge to date to a state's administration of the Medicaid Act under the "equal access" and "EPSDT" provisions.

After a four-week bench trial, at which Goldberg Kohn attorneys served as lead counsel, Judge Joan Lefkow issued an opinion that found that the Illinois Department of Public Aid and the Illinois Department of Human Services were violating the rights of Medicaid-eligible children in Cook County to receive health care under the Medicaid program. After reviewing Judge Lefkow's opinion, the parties negotiated a Consent Decree, pursuant to which the 600,000 members of the plaintiff class received dramatically enhanced health care under the Medicaid program in Illinois. The present value of the increased health care is hundreds of millions of dollars. For more information please click here.
