Roger Lewis, a principal in Goldberg Kohn's Litigation Group, recently spoke with Law360 about healthcare and life science litigation that is gearing up in 2022 regarding time-sensitive lawsuits as the U.S. Supreme Court nears the end of its current term.

As the Coronavirus pandemic includes an indirect death count that includes fatal overdoes, counselors who specialize in substance abuse and mental health are seeing greater demand because of the pandemic's effect on the mental health of many individuals.  Counseling employment is poised to grow faster than most other occupations according to the U.S. Department of Labor.

Mr. Lewis told Law360, "As more money flows to programs to address this part of the crisis, we can expect to see fraud.  Unscrupulous mental health and addiction centers will be under the microscope."

Signs of this kind of scrutiny have already started. The U.S. Department of Justice has begun using the Eliminating Kickbacks in Recovery Act, which became law in late 2018, to scrutinize sober homes with kickbacks at sober living homes being one of the main schemes spotlighted.
