How to Report Fraud for State False Claims Act (FCA) Cases

If you're a whistleblower with knowledge of fraudulent activities against a state government program or involving state funds, you may choose to file a case under a state False Claims Act (FCA). The majority of states have passed acts similar to the federal FCA, which allow whistleblowers to sue on behalf of the government for a chance to receive 15% to 30% of the government’s recovery.

If a whistleblower decides to pursue a state FCA case, they must serve the state a copy of the complaint and a disclosure statement. Therefore, it is important to have the most up-to-date contact information for each state’s Medicaid Fraud Control Unit (MFCU) or other relevant state entity.

Reporting Fraud in States Without State FCA Provisions

For MFCU whistleblowers in states that have not adopted their own False Claims Act — or those that do not have qui tam provisions, such as Arkansas — individuals can still report fraud to the state attorney general and through other state-specific anti-fraud measures, such as those listed here.
