David Chizewer, a principal in the firm's Litigation Group, recently discussed the misplaced concerns about the Department of Justice’s additional involvement in False Claims Act suits in an article by Bloomberg Law.
The article "DOJ Scrutiny of Whistleblower Suits Under Biden Unlikely to Stop" discusses the government's dismissal of "meritless" FCA suits, which many say hasn't been excessive or improper for there to be a major change under the incoming Biden administration.
“While no one believes their case is bad when filed, I have not seen an abuse of the dismissal authority since the Granston memo was authored,” said David. He continued by saying whistleblowers’ counsel “should welcome the use of the government’s dismissal authority to stop bad cases from moving forward and making bad law.”
